Canada makes us look good

Post by goose » Wed Jul 09, 2014 2:49 pm

For all the shit American lawyers get (and they get a lot of shit, some of it well deserved), Canada just topped us.

Woman kills teen in a traffic accident and then sues him and the other teens she injured for causing her emotional distress. Assuming she is represented by a lawyer, that guy should turn in his bar card tomorrow. Assuming she is not represented, the judge should just throw this meritless pile of shit out the door and sanction her for even considering such a suit.

Oh, you have suffered, have you, you entitled little child?!?! The kids you're suing have suffered getting dead. The one you ran over and his brother who ODed on polls and booze later. Their estate you're trying to dip your greedy paws into? That's their parents. They have suffered losing their kids. Because of you. You don't deserve that suffering, do you?!?!
Prof. Molecule on biglawnesline.com wrote:Ellis also told the Toronto Sun that Simon is unable to work and is simply responding to the legal actions filed by the families’.

... the kid you killed, who's parents have sued you for $900k, and rightfully so, that kid and his brother, who later ODed, they have lost their lives! They aren't destitute, they are dead! Yet, somehow, depression entitles you to a $1.35 million payout?!?!

:x :x :x

At first, I read the OP and think, okay, perhaps the kids were acting irresponsibly or criminally, driving drunk on the wrong side of the road or whatnot. That, perhaps, that cager honestly had some damages she didn't deserve. Then I read this and now my fucking blood fucking boils.
...
GUESS WHAT, YOU FUCKING CHILD! YOU KILL ANOTHER HUMAN BEING, YOU FEEL SHITTY! YOU GET INTO LEGAL AND FINANCIAL TROUBLE BECAUSE OF IT, YOU FEEL SHITTY! How shitty you feel because of something you have done is nobody's business but your own!

When I saw the date, late April, I thought, I hoped, two months, and a high-profile situation, maybe the court had already thrown it out and charged that fucking crybaby with wasting the crown's valuable time. No luck finding anything. Except that, while the fucking crybaby who's cop husband was the only witness to the accident wasn't charged with wrongdoing at the time, the rozzers have at least found it appropriate to reopen the accident investigation.

I'd like to punch her in the face, sue for medical expenses incurred on my bruised knuckles & repeat until she understands.
All proceeds go to help cripple children.

So fucking what? She hit them from her car from behind. Yep, stoned kids in the road in bad weather conditions from behind. Sounds like someone not paying fucking attention to me.

Furthermore, one of them died. Another had serious injuries. She is suing the dead kid's family for HER emotional distress? C'mon! Yeah, the dead kid's parents are suing for wrongful death. If she has this so-called "Stoned kids riding in the dark and it's all their own damned fault" defense, fine. She can raise it at trial and defend herself. But to sue a dead kid's family for her own "emotional distress" . . . . . absurd! Just my opinion of course.

If a lawyer thinks a lawsuit is absurd, it probably is.
But the lawsuit, the whole concept here, is beyond absurd or asinine.
I hope that a) the courts throws this out so hard, it makes an actual sound. I mean it, gavel going down and then, a big plonk noise.
B) the court that decides the parents' lawsuit finds them entitled to compensation for being sued by her like that, and doubles or triples their damages. It won't help, it won't bring their kids back. But at least it would hurt this cunt.

maybe the parents should counter-sue for the additional emotional distress that her suit is now causing them
